Mediation in traffic accidents

About two years ago, on January 1, 2016, Law 35/2015 came into force, reforming the system for assessing damages caused to people in traffic accidents. One of the modifications of this law was based on a new article that allows the possibility of reaching mediation in traffic accident cases.

An alternative route to civil court so that insurance companies and injured parties have the possibility of reaching an agreement on compensation, streamlining processing processes and optimizing costs.

According to article 14, in any alleged case of controversy, such as the victim disagreeing with the economic offer proposed by the insurance company, the mediation system can be requested by any of the parties involved, who have two months from receipt of the the offer of the mediation service to claim it. Likewise, the mediator must assume the task of resolving the conflict within a period of two months (extendable for one more month in exceptional situations) from the filing of the file.

If within this period of time the conflict is not resolved, it will be suspended and the jurisdictional procedure will be resorted to. However, if at any time both parties or one of them do not see a possible solution, they can give up.

The mediator in cases of accidents or traffic accidents must be a professional specialized in civil liability within the field of traffic and in the assessment system provided for in Law 35/21015. This must encourage an active behavior and attitude to reach an agreement between the parties, just as it is necessary for them to know the new scale and accredit specific training to perform their work as a mediator.
