UPO mediators lead the launch of an Intrajudicial Mediation Service in the Family Courts of Seville

This pilot program was born to comply with the provisions of articles 414.1, 440.1, 443 and 770.7ª, among others, of the LEC and under the protection of Law 5/2012 on mediation in civil and commercial matters, it is agreed launch an Intrajudicial Mediation Service in family proceedings in Courts nº 6, nº7 and nº23 of 1st Instance of Seville.

This pioneering program is provided by the Sevillian School of Mediation chaired by the lawyer Javier Alés, in accordance with the report presented by said entity dated November 26, 2013 and in accordance with the specifications contained therein.

Initially and without prejudice to being able to expand the List later or to the parties themselves requesting mediation in other matters not included, the Mediation Service will be offered in the processes, whatever falls under the jurisdiction of these three Family Courts and that the Judge/ to consider susceptible to mediation

The information that the Court must provide It will be carried out by means of an information pamphlet that is attached with the first personal summons from the Court to the parties and, if it were through the Attorney, with instructions to the Attorney that he must send it to his client.

The invitation by the Judge of the Family Court to the parties to attend the first information session on mediation provided for in articles 414.1 and 443.3 of the LEC will be carried out in such a way that the parties understand the advantages of mediation, requiring the parties, correlatively, to the decision they make, especially in the case of being negative, be explicit and reasoned sufficiently, as established in such articles.

This program approved by the Board of Family Judges of Seville allows the Sevillian School of Mediation promote the insertion of Mediation in the field of conflict resolution in the Sevillian municipality. The School creates a team made up of Mediation professionals, with proven experience in family matters (Beatriz Miguel, Eva Fuentes, Marisa Serrano and Teresa Fidalgo) who carry out a first session in which they inform the parties of the advantages of obtaining a mediated agreement versus the continuation of the contentious process. In just one month of the program being in effect, more than 30 cases have already been attended to.

This program represents an effort more than Mediation Specialist Course for bringing to Sevillians the culture of Mediation where a minute of speaking can resolve an entire life. For the next specialist course, UPO students will participate in live viewing of the cases.
