Opportunities for mediation in the criminal field

The criminal mediation begins to be regulated and, according to experts, it will bring with it a specific law that develops it.

Until just a few weeks ago, criminal mediation, at the national level, was regulated exclusively in the area of minors under the Organic Law 5/2000, of January 12, law regulating the criminal responsibility of minors. It introduced conciliation and reparation of damage as ways to resolve a conflict caused by a criminal act.

With the latest reform of the Penal Code Article 84.1 is modified, establishing that the judge or court may condition the suspension of the execution of the sentence to compliance with the agreement reached by the parties through mediation.

Mediation continues to boom, receiving acceptance and support from different national organizations for the use of this route over judicial means. Given the good results and the success obtained by this alternative resolution, there was already a fight for regulations that would regulate criminal mediation in adults. As an example of success we will cite: “The Provincial Court of Alicante”, one of the pioneering Autonomous Communities in this field, which has a Mediation office in which The percentage of matters resolved with agreement is 57%.
