Europe urges Spain to determine if the Mortgage Loan Reference Index was abusive

The European High Court urged Spain to determine whether there were abuses in the Mortgage Loan Reference Index (IRPH). This body requested that the Spanish courts clarify whether unethical practices were committed based on “not explaining what the IRPH was, what the calculation method applied was or whether it was understandable to the consumer what the economic consequences of applying this index and not the Euribor”, they pointed out.

 

As reported by the Periodic, Gema Candelaria Asencio, Councilor for Housing and Consumer Affairs of Crevillent, stated that the Government of Spain will have to be the one to propose “extrajudicial mechanisms” for those people who may be considered affected. Likewise, they advised that all those neighbors who have this reference index go to a professional who can advise them on what measures to take and, above all, putting mediation before judicial means.
