The European Intellectual Property Office, will create next year a mediation center so that different companies can resolve any conflicts and discrepancies that arise around trademarks or industrial designs and thus avoid going through the courts.
Yesterday, the last day of June, its executive director, Christian Archambeau, collected the Spanish Mediation Center award for the good use of these techniques as a method of conflict resolution.
Rafael Catalá, former minister of justice, stated that "every time we have a problem we go to court and that has to change" although according to Archambeau, despite having large numbers in the center of mediation, the number of cases is still “moderate.”
400 remarkably successful companies have already taken advantage of mediation, resulting in more than 80% of cases being resolved in an agreement satisfactory to both parties.
After the pandemic, the need to resolve conflicts quickly and definitively has become apparent, which is why the person in charge of the organization has told us that an online platform will soon be launched to be able to carry out the process remotely and ensure that it is more comfortable.
The presentation of this award took place during the day in which the Procedural Efficiency Law, which will make prior negotiation mandatory before filing a lawsuit in court.
The president of the Alicante Family Business Association (Aefa), Maite Antón, has highlighted the benefits that mediation can bring to this type of companies. “Conflicts can occur in all companies, because it is normal, but what is important is that these conflicts are resolved in a way that does not lose the «family relationship”Antón pointed out.
