In previous posts we have talked about the wide range of possibilities and areas to which mediation can be applied: civil, commercial, family, environmental, school, bankruptcy, community, and in this specific case, business.
Recently, the Illustrious Bar Association of Valencia (ICAV) has initiated actions aimed at promoting and encouraging business mediation, through an agreement signed with the Valencian Business Confederation (CEV).
The ICAV values very positively the measure that a clause for submission to mediation is always established in employment contracts, with the objective that the parties try to resolve the problem through mediation before resorting to ordinary judicial means.
What advantages does mediation have for companies?
Mediation is a highly recommended route for various types of business conflicts, especially in those cases in which the parties, despite having disagreements between them, must continue to maintain an employment relationship. It would also be the ideal option in cases of arguments between partners, disagreements with management, discomfort within work teams, or family conflicts linked to the world of work, among others.
It must be taken into account that the agreement reached through a mediation process is at the same level as a judicial resolution, with the difference that the solution has been agreed upon by the affected parties and not imposed externally by a third party.
Therefore, for a mediation process to exist, it is very important that there is a willingness and willingness to reach mutual understanding and an agreement that satisfies both contenders.
According to Francisco Nemesio, head of the Mediation and Economics area of the ICAV, mediation is already present and has a great future ahead: "In 30 years it will be the majority option to solve problems in all areas of society."
