The Ministry of Public Administrations, Justice and Security of Gran Canaria is committed to mediation and grants a subsidy to the Chamber of Commerce of Gran Canaria to maintain the civil and commercial extrajudicial mediation service.
The main objective is to decongest the current justice system, which usually deals with about 600 cases a year and which will be of great help to resolve them effectively and efficiently.
Commercial mediation pilot project
In 2020, the Chamber of Commerce was awarded a grant for a commercial mediation pilot project. A preliminary study carried out to evaluate its feasibility, duration, adversities and cost. Two years later the project was repeated for several reasons:
- Good results of the first project in 2020, in which 87% of cases have been processed
- Increased interest in mediation from both industry professionals and interested parties
Project work procedure
Firstly, the judicial body communicates to the Chamber of Commerce the cases chosen to enter the mediation process.
Next the parties are summoned to the briefing. If they do not attend the mediation service or only one of them does, the Chamber will officially communicate to the court considering that they are abandoning the mediation.
Otherwise, the information session will take place in which they will be will inform on the characteristics, procedure and legal consequences of mediation.
After the session, the court will be informed whether the parties have accepted or not and if they choose to continue, it will be carried out in accordance with the Chamber's Mediation Regulations.
If the mediation ends without agreement, this circumstance will be communicated to the judicial body. If there is an agreement, the mediator will ask the parties and their defenses if they wish to incorporate it into the process.
