The Junta de Andalucía, through the Extrajudicial System for the Resolution of Labor Conflicts of Andalusia (Sercla), has managed to conclude in the first half of the year with conflict agreement 42,37% prior to the strike who requested their conciliation-mediation service, this means, according to the data provided by the administration, that 297,968 hours of work were not lost, affecting 7,702 workers from 378 companies in Andalusia.
Since the creation of Sercla in 1999, 42.64 million hours have been avoided due to strikes. In addition, the performance of mediators from this entity represents the signing of 110 agreements in mediations in collective disputes in the first half of 2021.
Sercla has also processed individual labor disputes; during the first semester, 864 files were presented. Most of the files corresponded to conflicts in the Disciplinary Regime, Working Conditions and discrepancies in professional classification.
Online Mediation
The Andalusian Labor Relations Council (CARL), which manages SERCLA, began a online mediation system which has spread to all provinces, and is already leading to the signing of collective agreements negotiated entirely by videoconference, such as the one in Covirán last May.
This system, which was pioneered in Andalusia, was applied generally since October of last year in all conflicts, since the CARL agreed to prioritize telematic actions and online mediations while the health crisis persists.
The objective of this system is to avoid excessive judicialization of labor conflicts, favoring collective autonomy and its own means of solution.
