The Popular Party has recently presented 12 amendments to modify the Mediation Law. One of the new measures proposed is that mediation be free in the same cases as free justice.
The Bill to modify the Mediation Law was presented by the Government of Cantabria in Parliament last October 2016. The spokesperson for Justice of the PP, Isabel Urrutia, defends the importance of modifying the current regulations to improve some terms of the law that was approved in 2011 (in addition to warning of the possible unconstitutionality of requiring the registration of mediators).
In the words of Urrutia, it is essential to equate free mediation with the right to free legal assistance: “That the same people who would have the right to free legal assistance can benefit from this free mediation.” Although the Government of Cantabria affirms that it will always be determined by regulation who has the right and who does not.
Furthermore, the PP demands that free mediation begin to be implemented in Cantabria throughout the first half of next year 2017, taking into account that the law still needs prior regulatory development before citizens can enjoy this new right.
Within the 12 amendments, other aspects to be modified related to the Mediation Law are included, such as the following: that the autonomous community of Cantabria regulate in its territorial and jurisdictional scope to facilitate and guarantee citizens' access to mediation as an alternative solution. of conflicts. And, on the other hand, in accordance with the recommendation made at the time by the Council of State, the PP also introduces the modification of the functions of the Mediation Observatory, among other measures.
