In the case of young offenders, in 2018 the Ministry of Justice promoted more than 1,800 mediation procedures in Andalusia aimed at promoting the reintegration of these young people. The numbers speak for themselves: 1,443 were resolved positively (almost an 80%), thus avoiding trials.
And what is conflict resolution through Mediation in these cases about?
It should be noted that Andalusia now has eight mediation teams. The main objective of these teams is to make the offender take responsibility for the consequences of his or her fault or crime, and therefore, reward the damaged party with the measures established in each case. In this way, conflicts avoid reaching the courts, bodies that are currently saturated.
In 2018, the Ministry of Justice points out that reparations and the effectiveness of mediation processes are increasingly higher. In fact, 59% of the conflicts were settled with reparation for the damage caused by the minor, the 28% with a conciliation act and also a repair and only the 13% only with a conciliation act.
These data reflect the effectiveness of mediation, which not only serves to resolve conflicts but also to teach young people about other peaceful and conciliatory ways to resolve problems. On the other hand, it is important to highlight that this type of process is less costly, both in time and money, for the injured party and for the families of the young offenders.
Mediation as teaching for young Spaniards
Without a doubt, The data extracted in Andalusia demonstrate that our society is increasingly more aware and prepared for this way of resolving conflicts.. That in Andalusia there are already 8 mediation teams and that their data is so positive, gives hope for the resolution of problems in a friendly and beneficial way for both parties.
It is important to highlight that In this type of extrajudicial conflict resolution, the participation of all parties involved is essential, which reinforces and works on the idea of consensual and friendly solutions, transmitting these values to new generations.
There is more and more positive data on the implementation and effectiveness of Mediation as a way to resolve conflicts, making it necessary for more professionals to be trained in this discipline. Public organizations encourage and use mediation, which is already an important part of avoiding (even more) the saturation of the courts.
