Last Friday, November 6, the Superior Court of Justice of Extremadura (TSJEx) and the Chamber of Commerce of Badajoz launched a pioneering protocol in Spain in order to promote civil and commercial mediation by referral from the Courts of First Instance and Commercial Courts of Extremadura.
This agreement aims to provide citizens with an alternative conflict resolution procedure through dialogue and the search for fair agreements.
The members of the commission that carried out the signing of the protocol were the president of the Superior Court of Justice of Extremadura, María Félix Tena Aragón, and the president of the Badajoz Chamber of Commerce, Mariano García Sardiña, who were accompanied by the president of the Provincial Court of Badajoz, Luís Romualdo Hernández Díaz-Ambrona, and the member of the Executive Committee of the Badajoz Chamber of Commerce, Ángel Luís Gómez.
The protocol, which will be applied throughout the region, will address processes related to: bankruptcy mediation, contractual breaches, claims for debts and credits, corporate conflicts, property conflicts, commercial disputes, leases and inheritances.
María Félix Tena highlighted that this is the first protocol of this level to be signed in the country, and that it aims to find the best solution to the conflict with the mediation of specialists, so that citizens obtain a service that saves time and expenses and in which all operators are involved.
For his part, the president of the Chamber of Commerce Mariano García Sardiña, added that this service is a practical and quick conflict resolution mechanism and that it also contributes to improving the competitiveness of companies.
The Courts of First Instance and Commercial Courts will be in charge of deciding which procedures can go to mediation and will be communicated to the Chamber of Commerce.
Thus, the Badajoz Chamber of Commerce will make a specific Mediation Center available to citizens as an alternative to conflict resolution. Likewise, this service can be carried out online to guarantee effective judicial protection.
