And this was demonstrated last Wednesday, August 12, when the Extrajudicial System for the Resolution of Labor Conflicts in Andalusia (Sercla), attached to the Andalusian Labor Relations Council (CARL), carried out the first mediation exercises through videoconference in Huelva.
It is a very beneficial measure for the general scope of mediation since it frees up face-to-face negotiation measures. It is evident that for these actions to be carried out there must be an agreement between the parties involved and that they have the necessary computer equipment, which can be a computer with a webcam and microphone or a smartphone.
As reported by the Board in a press release: Sercla's online mediation is part of the range of measures proposed by the Andalusian Labor Relations Council for the reactivation and facilitation of the consensual solution of labor disputes during and after the situation of confinement due to the Covid-19 health crisis.
The territorial delegate of Employment, Training, Self-Employment, Economy, Knowledge, Business and University in Huelva, Antonio Augustín, declares in this way that "In these first mediations, both parties to the conflict have participated, as well as the people who make up the mediation commission, using a specific platform for ODR (Online Dispute Resolution) management."
"These actions derive from a pilot experience carried out since the end of April by Sercla and a pioneer in Spain, having been the first public entity that has held labor mediation completely online," has continued.
The delegate has reported that since the beginning of the state of alarm, technical, training and procedural preparations began for the start of this telematic labor mediation initiative, which has been "successful" thanks to the collaborative effort of various regional, national and international organizations. .
Among the institutions that have already carried out mediation electronically are ODR Latin America and the SIMA Foundation, an organization for the Autonomous Resolution of Labor Conflicts at the State level. And it cannot be ruled out that it begins to be implemented in other organizations or institutions assigned to the field of mediation.
