Today, Wednesday, February 3, the "International Lawyer's Day" is celebrated in tribute to all lawyers for advise and defend<\/strong> the legal rights and interests of others, public or private. <\/p>\n\n\n\n

To enforce the laws in this society, it is necessary to have qualified personnel who have the following requirements:<\/p>\n\n\n\n

Knowledge<\/strong><\/h2>\n\n\n\n

Professionals with knowledge in the legislative area<\/strong> (criminal, labor, administrative...), as well as others general<\/strong> such as culture, history, philosophy, literature, economics and politics, among others. <\/p>\n\n\n\n

Skills<\/strong><\/h2>\n\n\n\n

What skills should a good lawyer have? These should have general academic skills<\/strong> as:<\/p>\n\n\n\n

Research, critical analysis, reasoning, planning, strategy formulation, problem solving, acquisition of a legal position as well as the ability to communicate.<\/p>\n\n\n\n

Mediation and advocacy<\/strong><\/h2>\n\n\n\n

What we all want is a solution to our problems<\/strong>. This solution involves an analysis of the conflict by the lawyer that can lead to different alternatives: negotiation, arbitration, extrajudicial conciliation or mediation.<\/p>\n\n\n\n

In this way the mediation<\/strong> It becomes part of the legal profession as a valuable and necessary tool, both intrajudicial and extrajudicial.<\/p>\n\n\n\n

The objective is to advise clients so that both parties can reach the necessary agreements and resolve the conflict in a manner efficient, direct and economical<\/strong>.<\/p>\n\n\n\n

For this, different phases are taken into account:<\/p>\n\n\n\n

Before mediation<\/strong><\/p>\n\n\n\n

The role of the lawyer must be focused on analyzing the conflict, observing the differentiating elements, evaluating the object of the conflict, evaluating the alternatives, managing the CGPJ guide, providing information about mediation, accompanying clients, actively participating, collaborating with the mediator, design a strategy and collect the accrual of the amounts.<\/p>\n\n\n\n

The role of the lawyer should be to actively assist during the mediation process and advise the client, maintain flexibility during the process and organize the planned actions.<\/p>\n\n\n\n

The role of the lawyer should be to provide legal form to the agreement reached, request judicial approval of the agreement, advise the client to configure the agreement and carry out compliance with the agreements.<\/p>\n\n\n\n
