At that moment, he appears\u2026 the mediator. He doesn&#039;t wear a cape (though he should), but he does have something even more powerful: <strong>negotiation tools<\/strong>.<\/p>\n\n\n\n<p>Because let&#039;s be honest: mediation isn&#039;t just &quot;sitting down and talking calmly.&quot; It&#039;s a strategic art where the mediator becomes the conductor, emotional translator, and architect of the agreement.<\/p>\n\n\n\n<p>Today we&#039;re going to see how negotiation techniques and mediation go together perfectly... like a wedding where nobody fights over the seating plan.<\/p>\n\n\n\n<p><strong><strong>Active listening: sharpen those ears<\/strong><\/strong><\/p>\n\n\n\n<p>The mediator&#039;s first tool is not a contract, nor a legal code: it is listening.<\/p>\n\n\n\n<p>But not just any listening, but <strong>active listening<\/strong>, That which is not about waiting your turn to speak, but about truly understanding.<\/p>\n\n\n\n<p>A trained mediator listens to what is said\u2026 and also to what is not said:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>hidden interests<\/li>\n\n\n\n<li>emotions in disguise<\/li>\n\n\n\n<li>real needs<\/li>\n<\/ul>\n\n\n\n<p>Because often the conflict isn&#039;t about money, but about a feeling of injustice. And that can&#039;t be fixed with a calculator, but with empathy.<\/p>\n\n\n\n<p><strong><strong>Brainstorming: a storm of ideas without lightning<\/strong><\/strong>\u00a0<\/p>\n\n\n\n<p>When the parts are locked, this usually happens:<\/p>\n\n\n\n<p>\u2014 \u201cEither you give me this or there\u2019s no deal.\u201d<\/p>\n\n\n\n<p>\u2014 \u201cWell then, nothing.\u201d<\/p>\n\n\n\n<p>End of conversation.<\/p>\n\n\n\n<p>This is where the mediator comes in as a generator of creativity. A key technique is the <strong>brainstorming<\/strong>, or brainstorming, where the aim is to open up possibilities without judging them at first.<\/p>\n\n\n\n<p>In mediation, this translates to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>generate options<\/li>\n\n\n\n<li>break rigid positions<\/li>\n\n\n\n<li>discover unexpected solutions<\/li>\n<\/ul>\n\n\n\n<p>Because sometimes the agreement isn&#039;t &quot;50\/50,&quot; but &quot;60\/40 with additional compensation.&quot; The mediator helps you think outside the box\u2026 before the box becomes a ring.<\/p>\n\n\n\n<p><strong>BATNA: The Negotiator&#039;s Famous &quot;Plan B&quot;<\/strong><\/p>\n\n\n\n<p>BATNA sounds like a Marvel villain, but it&#039;s actually one of the most important negotiation techniques.<\/p>\n\n\n\n<p>Means:<\/p>\n\n\n\n<p><strong>Best Alternative To a Negotiated Agreement<\/strong> (that is, the best alternative if there is no agreement).<\/p>\n\n\n\n<p>A mediator should help each party to ask themselves:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What happens if we don&#039;t reach an agreement?<\/li>\n\n\n\n<li>How much does it cost to go to court?<\/li>\n\n\n\n<li>What are the risks?<\/li>\n<\/ul>\n\n\n\n<p>When a person understands that their alternative is worse than negotiating, they magically become more flexible. It&#039;s not magic: it&#039;s strategy.<\/p>\n\n\n\n<p><strong><strong>Agreement zone: the point where everyone wins (or at least doesn&#039;t lose)<\/strong><\/strong>\u00a0<\/p>\n\n\n\n<p>In negotiation there is a mythical place: the <strong>area of possible agreement<\/strong>. It is the space where the interests of both parties can coincide.<\/p>\n\n\n\n<p>The mediator works like an explorer searching for that middle ground:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>detects common interests<\/li>\n\n\n\n<li>reduces tension<\/li>\n\n\n\n<li>balances expectations<\/li>\n<\/ul>\n\n\n\n<p>This is where mediation shines: it&#039;s not about imposing, but about building a solution acceptable to everyone.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The mediator: more than an arbitrator, a coach of the agreement<\/strong><\/h2>\n\n\n\n<p>The mediator is not a judge, nor a therapist, nor simply a moderator. They are a hybrid figure who combines:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>negotiation technique<\/li>\n\n\n\n<li>emotional communication<\/li>\n\n\n\n<li>legal structure<\/li>\n\n\n\n<li>practical creativity<\/li>\n<\/ul>\n\n\n\n<p>Mastering these tools makes the mediator someone capable of transforming a conflict into an agreement.<\/p>\n\n\n\n<p><strong>Conclusion: Negotiating well means mediating better.<\/strong><\/p>\n\n\n\n<p>Mediation is the stage, but negotiation is the script.
