The Ministry of Justice has taken another step regarding mediation and its state regulation through Law 5\/2012 of civil and commercial mediation<\/a>. It is a new ministerial order<\/strong>, the Order JUS\/746\/2014, of May 7<\/em>, which has already been officially published in the BOE on May 9 and has come into force one day after its publication.<\/p>\n

The preparation of this order responds to the need to expand and develop articles 14 and 21 of the Royal Decree 980\/2013<\/em><\/strong>, December 13,<\/em> which are the following:<\/p>\n

Art. 14 \u2013 Information to be provided by mediators<\/em><\/p>\n

Art. 21 \u2013 Information to provide to the Registry<\/em><\/p><\/blockquote>\n

Although these articles contain the general aspects related to the information required regarding registration in the Registry of Mediators, the order details more specifically what the electronic documents<\/strong> that must accompany the information provided by applicants for registration through the Ministry's electronic headquarters.<\/p>\n

Furthermore, as the main novelty, it establishes the creation of the file of mediators and mediation institutions<\/strong>, which is incorporated into Annex I of the Order JUS\/1294\/2003, of April 30, which determines the files with personal data of the department and its public bodies<\/em>. <\/i><\/p>\n

Although there have been no significant legislative changes, this is important information that must be taken into account by any mediator or mediation institution interested in accessing the Registry with a view to regulating their mediation activity and subsequently obtaining benefits thanks to the advertising thereof.<\/p>\n

The Registry of Mediators is now open to registration since April 1, 2014, and is expected to become fully operational starting June 1.<\/p>\n
